USER INFORMATION
Who is responsible for the processing of your personal data?
FINCA LA GRACIA is the RESPONSIBLE for the processing of the USER’s personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018 of 5 December (LOPDGDD).
What do we process your personal data for and why do we do it?
Depending on the form where we have obtained your personal data, we will treat them confidentially to achieve the following purposes:
In the Reservations form
- Formalize reservations at the establishment of the responsible party (for the execution of a contract or pre-contract, 6.1.b GDPR).
- Send commercial advertising communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, to customers, which enable commercial communications concerning products or services that are similar to those initially contracted with the customer (art. 21.2 LSSI) (for the legitimate interest of the responsible party, art. 6.1.f GDPR).
In the Contact form
- To respond to queries or any type of request made by the user through any of the contact forms made available on the website of the responsible party (for the legitimate interest of the responsible party, art. 6.1.f GDPR).
- To carry out statistical analysis and market research (for the legitimate interest of the data controller, art. 6.1.f GDPR).
How long will we keep your personal data?
They will be kept for no longer than necessary to maintain the purpose of the processing or there are legal prescriptions that dictate their custody and when it is no longer necessary for that purpose, they will be deleted with appropriate security measures to ensure the anonymization of the data or the total destruction of the data.
The time of conservation of the Users’ personal data is subject to the criterion of the statute of limitations of the actions deriving from the underlying legal business, from which the Users’ data that are the object of the processing have been obtained.
To whom do we provide your personal data?
No communication of personal data to third parties is foreseen except, if necessary for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE has signed confidentiality and data processor contracts required by the privacy regulations in force.
Personal data of minors
Respecting the provisions of Articles 8 of the RGPD and 13 of the RDLOPD, only those over 14 years of age may give their consent to the processing of their personal data in a lawful manner by the City Council.
In the case of a minor under 14 years of age, the consent of the parents or guardians will be required for the processing, and this will only be granted in cases in which the parents or guardians have given their consent. To this end, they may send a communication to the address info@fincalagracia.es.
Notwithstanding the above, and in general, FINCA LA GRACIA will not process personal information, with reliable knowledge, of minors under 14 years of age.
In the event that the City Council, carrying out any control activity, discovers the unintentional collection of information regarding children under 14 years, will carry out all necessary measures that, as a provider and host of Content, is obliged to undertake and thus be able to delete such information as soon as possible, except in those cases that, by reason of applicable law, it is necessary to retain or mediate the consent of parents, guardians or legal representative of the minor, as indicated above.
What are your rights?
The rights granted to the USER are the ARGO rights set forth in Article 15 et seq. Of the RGPD, and are:
a). Right of access: this is the User’s right to obtain confirmation as to whether the City Council is processing his/her personal data and, if so, to obtain information on his/her specific personal data and the processing that FINCA LA GRACIA has carried out, carries out, as well as, among others, the information available on the origin of said data and the recipients of the communications made or planned for said data.
b). Right of rectification: this is the User’s right to have his or her personal data amended if it proves to be inaccurate or, taking into account the purposes of the processing, incomplete.
c). Right of deletion (“the right to be forgotten”): is the User’s right, unless otherwise provided for by the legislation in force, to obtain the erasure of his/her personal data when such data are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn his/her consent to the processing, and the processing has no other lawful basis; the User objects to the processing and there is no other legitimate reason to continue with the processing; the personal data have been processed unlawfully; the personal data must be deleted in compliance with a legal obligation; or the personal data have been obtained as a result of a direct offer of FINCA LA GRACIA Services to a minor under 14 years of age. In addition, the technology available and the cost of its implementation, shall take reasonable steps to inform those responsible for processing the personal data of the data subject’s request for deletion of any link to such personal data.
d). Right to limitation of processing: this is the User’s right to limit the processing of his/her personal data. The User has the right to obtain the limitation of the processing when he/she contests the inaccuracy of his/her personal data; the processing is unlawful; the controller no longer needs the personal data, but the User needs it to make claims; and when the User has objected to the processing.
e). Right to data portability: in case the processing is carried out by automated means, the User shall have the right to receive from the controller his/her personal data in a structured, commonly used, machine-readable format and to transmit it to another controller. Whenever technically feasible, the controller shall transmit the data directly to such other controller.
f). Right of opposition: this is the User’s right not to have his or her personal data processed.
g). Right not to be subject to a decision based solely on automated processing, including profiling: this is the User’s right not to be subject to an individualized decision based solely on automated processing of his or her personal data, including profiling, unless otherwise provided for by law.
Thus, the User may exercise his/her rights by means of a communication addressed to the data controller at the address info@fincalagracia.es in which the User must specify the following data:
– Name, surname of the User and copy of the DNI. In the cases in which the representation is admitted, it will also be necessary the identification by the person who represents the User, as well as the document accrediting the indicated representation. The photocopy of the DNI may be substituted by any other means valid in law that accredits the entity.
– Request with the specific reasons for the request or information to be accessed.
– Address or e-mail address for notification purposes.
– Date and signature of applicant
– Any document that accredits the request being formulated.

MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
USERS, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly and freely and unequivocally accept that their data are necessary to fulfill their request, by the provider, being voluntary the inclusion of data in the remaining fields. The USER guarantees that the personal data provided to the RESPONSIBLE are truthful and is responsible for communicating any changes to them.
The RESPONSIBLE informs that all data requested through the website are mandatory, as they are necessary for the provision of optimal service to the USER. In the event that all the data is not provided, there is no guarantee that the information and services provided will be completely tailored to your needs.
SECURITY MEASURES
That in accordance with the provisions of the regulations in force on personal data protection, the RESPONSIBLE is complying with all provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR, whereby they are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
The RESPONSIBLE guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of the USERS and has communicated the appropriate information to them so that they can exercise them.
It is necessary that the User has read and agrees with the conditions on the protection of personal data contained in this Privacy Policy, as well as that he/she agrees to the processing of his/her personal data so that the data controller can proceed in the manner, for the periods and for the purposes indicated. The use of the website will imply acceptance of the privacy policy of this.
FINCA LA GRACIA reserves the right to modify its Privacy Policy, according to its own criteria, or motivated by a legislative, jurisprudential or doctrinal change of the control authority (Spanish Data Protection Agency). Changes or updates to this Privacy Policy will be explicitly notified to the User.
This Privacy Policy is adapted to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
